Terms and Conditions Marketing Maatwerk

Welcome to Marketing Maatwerk! I'm glad you want to work with me. To keep this collaboration smooth and clear, I've drawn up these terms. Don't worry, it's not an unreadable legal document, but a clear guide to my collaboration with you.

Article 1: Who am I and what is this?

Ground rules:

These are the terms and conditions: the rules that apply to every quote, assignment and agreement between you and Marketing Maatwerk. They make clear which rights and obligations both you and I have.

Article 2: How does the collaboration start?

The Quote: Everything starts with a quote that I create based on your wishes and send by email. It clearly states what I'm going to do, what it costs and what the schedule is.

Your Approval: My agreement becomes official when you accept the quote via the 'View and accept quote' button in the email you receive from me. By accepting the quote, you also confirm that you have read and agree to these terms and conditions.

Validity: The quote is valid for 14 days, unless stated otherwise.

Article 3: Prices and Payment

Prices: All prices stated are excluding 21% VAT.

Payment term: I apply a payment term of 14 days after the invoice date. For agreements with other companies or the government, the statutory payment terms apply, unless we agree otherwise in the contract.

Deposit: For larger projects I may ask for a deposit (for example 50%) before I start. This is then clearly stated in the quote.

Retention of title: All delivered products (such as a website or design) remain the property of Marketing Maatwerk until the full invoice has been paid. This means I have the right to reverse the delivery if payment is not made.

Article 4: My collaboration with you: Your input & my commitment

Your Role: I achieve a good result together with you. I need your input, such as texts, images, logos and timely feedback. If you don't provide these on time, this may affect the project's schedule.

My Role: I fully apply my expertise and creativity to make the project a success. I keep you informed of progress and ensure a professional end result.

Delivery conditions: In the quote I specify the delivery time and other conditions regarding the delivery of the project.

Article 5: Specific Services

A. Website in 1 Day

Approach: After my first contact with you I schedule a strategy session. Ahead of this session I draw up the quote. I discuss it with you during the session and the project only starts after you have officially accepted the quote.

Preparation: Your 'homework' (providing all content) must be complete before the build day.

Cancellation: Do you want to cancel the appointment after accepting the quote? That can be done free of charge up to 14 days before the scheduled build day. If you cancel within 14 days before the build day, I am obliged to charge 20% of the quote amount in connection with the reserved time and preparations made.

B. Custom Website & SEO

SEO (Search Engine Optimisation): I make every effort to improve the findability of your website. However, SEO is a continuous process and results depend on many factors (such as competition and Google's algorithms). For this reason I cannot give guarantees for specific positions in search engines.

Cancellation of Monthly Services (such as SEO): Monthly services can be cancelled per month, with a notice period of one full calendar month.

C. Web Hosting & Domain Names

Responsibility: I provide a technically stable and secure hosting environment. I strive for maximum availability (uptime).

Fair Use: The hosting may not be used for illegal activities or for sending spam. In case of misuse, the service may be (temporarily) suspended.

Contract term: Hosting and domain name contracts are taken out for a year and are renewed automatically, unless you cancel in writing no later than one month before the end date.

Article 6: Warranty and Liability

Warranty: You are entitled to a sound product. The website or service must do what it promises. I offer a 30-day warranty on the technical operation of the delivered website. Errors discovered within this period that are demonstrably caused by me, I repair free of charge.

Liability: Should something go wrong, my liability is limited. I can never be held liable for more than the amount invoiced for that specific service. I am not liable for indirect damage (such as lost revenue) or damage caused by incorrectly supplied information from you.

Article 7: Intellectual Property

Your Property: All content you supply (text, images, etc.) remains yours.

My Work: After full payment of the invoices, you receive the full right of use of the end product (the website). The intellectual property of the code, concepts or designs developed by me remains with Marketing Maatwerk, unless we agree otherwise in writing.

Portfolio: I'm proud of my work and reserve the right to use the delivered project for my own portfolio and promotion.

Article 8: Force Majeure

Sometimes things happen that no one can do anything about (such as a natural disaster, war, or a prolonged national internet outage). If I'm unable to meet my obligations due to such a situation, we refer to it as force majeure. I will then look for a reasonable solution together with you.

Article 9: Reviewing the Terms

Availability: You must have the opportunity to read these terms before we enter into an agreement. That's why they are always clearly available and downloadable as a PDF file on my website.

Changes: If I change these terms in the future for an ongoing service (such as a hosting subscription), I will inform you about this. You then have the right to cancel the agreement if you do not agree with the change.

Article 10: Complaints and Disputes

Talk First: Do you have a complaint? Let me talk it through with you first. We usually work it out through good consultation.

Law: Should it nevertheless come to a dispute, Dutch law applies and the matter will be submitted to the competent court in my region.
