Welcome to Marketing Maatwerk! Glad you want to work with me. To keep this collaboration smooth and clear, I've written these terms. Don't worry, this isn't an unreadable legal document, it's a straightforward guide to how we'll work together.
These are the terms and conditions: the rules that apply to every quote, assignment and agreement between you and Marketing Maatwerk. They make clear what rights and obligations you and I both have.
The quote: everything starts with a quote I put together based on your needs and send by email. It clearly states what I'll do, what it costs, and the planning.
Your agreement: the agreement becomes official once you accept the quote. By accepting the quote, you also confirm you've read these terms and agree to them.
Validity: the quote is valid for 14 days, unless stated otherwise.
Prices: all stated prices are exclusive of 21% VAT.
Payment term: I use a payment term of 14 days from the invoice date. For agreements with other businesses or government bodies, the statutory payment terms apply, unless agreed otherwise.
Deposit: for larger projects I may ask for a deposit (e.g. 50%) before starting. This will be clearly stated in the quote.
Retention of title: all delivered products (such as a website or design) remain the property of Marketing Maatwerk until the invoice has been paid in full.
Your role: a good result is something we achieve together. I need your input, such as texts, images, logos and timely feedback. If you don't deliver these on time, it can affect the project's planning.
My role: I put my full expertise and creativity into making the project a success. I'll keep you updated on progress and ensure a professional final result.
Delivery terms: the quote specifies the delivery time and other terms around completing the project.
SEO: I put in my full effort to improve your website's findability. SEO is an ongoing process though, and results depend on many factors, so I can't guarantee specific search engine positions.
Cancelling monthly services (such as SEO): cancellable per month, with a notice period of one full calendar month.
Responsibility: I provide a technically stable and secure hosting environment, aiming for maximum uptime.
Fair use: hosting may not be used for illegal activities or sending spam. In case of abuse, the service may be (temporarily) suspended.
Contract term: hosting and domain name contracts run for one year and renew automatically, unless you cancel in writing at least one month before the end date.
Warranty: you're entitled to a properly functioning product. I offer a 30-day warranty on the technical functioning of the delivered website. Errors discovered within this period, and demonstrably caused by me, are fixed free of charge.
Liability: should something go wrong, my liability is limited to the amount invoiced for that specific service. I'm not liable for indirect damages or damages caused by information you supplied incorrectly.
Your property: all content you supply (text, images, etc.) remains yours.
My work: once invoices are paid in full, you receive the full right to use the end product (the website). Intellectual property of the code, concepts or designs I develop remains with Marketing Maatwerk, unless agreed otherwise in writing.
Portfolio: I retain the right to use the delivered project in my own portfolio and for promotion.
Sometimes things happen that nobody can help (like a natural disaster, war, or a prolonged nationwide internet outage). If I can't meet my obligations because of such a situation, that's force majeure. I'll then work with you to find a reasonable solution.
Availability: you must have the chance to read these terms before we enter into an agreement. That's why they're always available on this page.
Changes: if I change these terms in the future for an ongoing service (such as a hosting subscription), I'll inform you. You then have the right to terminate the agreement if you disagree with the change.
Let's talk first: got a complaint? Let's talk it through together first. We usually work things out in good consultation.
Governing law: should it come to a dispute, Dutch law applies and the matter will be brought before the competent court in my region.
